Immediate Report - Petition to Approve a Claim as a Class Action Lawsuit against yes

An Immediate Report is hereby provided that on October 26, 2021 the Company was informed by the subsidiary DBS Satellite Services (1998) Ltd. (“yes”) that it had received a petition to approve a claim as a class action lawsuit that had been filed against it with the Jerusalem District Court (the “Petition”). The Petition alleges that yes is acting unlawfully in that when a customer orders a more advanced (new) set-top box from it, yes provides the customer with the new set-top box without removing the old set-top box and continues to charge the customer monthly fees for the old set-top boxes still at his/her home. The applicant claims that in doing so, yes acts, among other things, in bad faith, deceptively and misstates invoices.

The group definition, according to the application, is all yes customers who were charged monthly fees for old, inactive standard set-top boxes, which had not been removed by yes during the seven years preceding the filing of the Petition until the date of its approval. The amount of personal damage claimed is NIS 193 (NIS 183 for overcharging and NIS 10 for breach of autonomy). The Petition notes that, at this stage, it is impossible to estimate the damage amount for the members of the group.
